Terms of Service
Please read these terms carefully before using BaseImage services.

1. Acceptance of Terms
By accessing or using the BaseImage platform ("Service"), accessible from baseimage.io, you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service.
2. Description of Service
BaseImage provides automated container hardening, vulnerability scanning, and patching services. While we strive to provide the most secure configurations based on industry standards (CIS, NIST), security is a shared responsibility.
You acknowledge that no software is completely immune to vulnerabilities. BaseImage does not guarantee that your infrastructure will be invulnerable to all attacks, and our scans may not identify every existing or future threat.
3. User Accounts & Security
- You are responsible for maintaining the security of your account and API keys.
- You must immediately notify us of any unauthorized use of your account.
- BaseImage will not be liable for any loss or damage from your failure to comply with this security obligation.
4. Subscriptions & Payments
Certain aspects of the Service are provided for a fee ("Paid Tiers").
- Billing: You agree to provide accurate and complete billing information.
- Cancellation: You may cancel your subscription at any time. Your access to Paid features will continue until the end of your current billing period.
- Refunds: All fees are non-refundable unless required by law or explicitly stated in a specific Service Level Agreement (SLA).
5. Disclaimer of Warranties
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. BaseImage expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We make no warranty that the Service will meet your specific requirements, be uninterrupted, timely, secure, or error-free.
6. Limitation of Liability
In no event shall BaseImage, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
In no event will our total liability to you for all damages, losses, or causes of action exceed the amount you have paid BaseImage in the last twelve (12) months, or, if greater, one hundred dollars ($100).
7. Indemnification
You agree to defend, indemnify, and hold harmless BaseImage and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, or b) a breach of these Terms.
8. Service Level Agreements (SLAs)
Patching SLAs apply only to specific Paid Tiers.
While we aim to meet these targets 100% of the time, specific remedies for missed SLAs are defined in the individual Enterprise Master Service Agreement (MSA) where applicable. For standard online tiers, SLAs are targets, not guarantees.
9. Termination & Acceptable Use
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever. You agree not to use the Service to distribute malware, conduct unauthorized penetration testing on third-party infrastructure, or violate any applicable laws. Breach of these conditions will result in immediate termination.
10. Governing Law
These Terms shall be governed and construed in accordance with the laws of [Your State/Country], without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
